Bollywood actor Shiney Ahuja, who has been in judicial custody for three months after being charged with raping his domestic help, got bail Thursday on surety of Rs 50,000.

"There is no clear evidence that Shiney had raped his maid," said his lawyer Shirish Gupte.

Shiney was arrested on June 15 for allegedly raping his maid at his residence in suburban Oshiwara.

The court has ordered the actor to deposit his passport with the officer investigating the case.

Bollywood actor Shiney Ahuja, arrested for allegedly raping his domestic help, has been shifted to the state-run JJ Hospital in Mumbai, after he complained of acute back pain due to slip disc.

A sessions court directed the authorities at the Arthur Road Jail, where the actor is lodged since his arrest in June this year, to provide medical treatment and admit him to a hospital if need arose, PTI reported.

The 36-year-old actor, who was produced before the court, was seen limping and taking the support of two constables as he was not able to walk.

Ahuja was arrested on June 15 for allegedly raping his domestic servant at his residence in suburban Oshiwara.

The court will hear the arguments of the prosecution and defence on the framing of charges against the actor on October 7.

A Mumbai court on Sept 11 rejected the bail application of actor Shiney Ahuja, accused of raping his teenaged domestic help.

The actor's bail plea, which was pending before a Mumbai sessions court, had been transferred to a fast track court last month, said his lawyer Shrikant Shivade.

Shiney has been accused of raping his domestic help at his Andheri West home on June 14.

The charges against the actor will be framed on Sept 23 before fast track court judge S.R. Trivedi, Shivade told IANS.

After the charges are framed, the trial - in which the prosecution would examine around two dozen witnesses - shall commence on a regular day-to-day basis by month-end.

The prosecution does not intend to examine all the witnesses who are lined up and it expects the trial to be completed within two weeks, according to a prosecution lawyer.

Shiney, who will continue in judicial custody at the Arthur Road Jail, faces a minimum seven-year jail sentence if the charges against him are proved in court.

Shiney’s maid obsession continues

Shiney Ahuja is praying hard for a maid in his jail cell. But unfortunately isn’t able to vocalise those very thoughts considering the situation he is in right now.

The actor jailed for allegedly raping his maid is faced with serious water woes in his cell in Arthur Road Jail. Shiney’s jail cell overflows if it rains for more than 12 hours and is left to clean up his mess along with prison mate and underworld don Abu Salem.

Due to this, Shiney had even asked to be shifted from his barracks or made to sit outside his cell but wasn’t allowed to do so. Instead the guards gave him four buckets to drain out the water and Shiney couldn’t do much but comply with the orders.

A jail official stated recently, ‘Prisoners have to do all the work themselves. If it rains, they have to clean up too.’ The reason behind the flooding in the cells is because the drainage system of the 80-year-old prison has failed, leading to accumulation of sewage that hosts mosquitoes and insects.

Sadly Shiney will remain in judicial custody till July 30 when the court hears his bail plea again. For now, Shiney just seems to be learning more about 'doing' manual labour.

New Delhi, July 4 (IANS) Bollywood actor Shiney Ahuja's 18-year-old domestic help has categorically stated she was raped by him, the National Commission for Women (NCW) chief said here Saturday.

When we had talked to the girl in Mumbai, she had categorically stated that she was raped," Girija Vyas told reporters here.

Asked about Shiney's statement that he had "consensual sex" with the maid, the NCW chief said: "Even the medical and the DNA reports proved that she was raped. But now I cannot say anything as the case is in court."

The actor had previously said in court that he had consensual sex with his maid and argued that the rape charge was a conspiracy to extort money from him, as mentioned Masala magazine. The actor was arrested after the victim alleged that he had raped her on June 14.

Earlier, police said DNA test reports confirmed that Shiney had sex with his domestic help. The police had said the DNA samples of the accused matched the samples taken from the victim, who also suffered scratch marks on her body.

An NCW team, including Vyas, had rushed to Mumbai and met all the parties concerned, including the victim and her family members. Following the visit, Mumbai Chief Minister Ashok Chavan had announced that the Shiney Ahuja rape case would be transferred to a fast track court soon.

Forensic Reports have confirmed that the semen taken from the maid’s body is indeed Shiney Ahuja’s. The actor has applied for bail on basis of his clean record and good upbringing.

Ahuja’s Lawyer Shrikant Shivade told in court, “Ahuja’s bail application mentions four grounds, He has no criminal antecedents, he is from a good family, and the trial could take a long time which may affect his unfinished films.” The actor has been spending his days and nights in solitary confinement, a mere 8 by 5 cell at the Arthur Road jail and is unaware of the happenings.

The DNA report supports the maid's FIR and if the court favours the maid on the hearing on July 2nd, Shiney is looking at close to 7 to 14 years in jail. Still Ahuja’s family members are undeterred and have stated that they have faith in the judicial system and the lawyers will make sure that Shiney is given a clean chit.

Along with the positive DNA report, a police officer said, “There were injury marks on the private parts of the victim and the accused had scratches on his wrist and finger. It clearly shows that the intercourse was forced,” The report on nail clippings of the victim - to find if there is any skin or blood that matches with that of the accused - is still awaited.

It seems pretty clear that Shiney’s fate is sealed; the actor doesn’t have much luck riding on his side. However, if a bail is granted because he is from a good family, then things could get really ugly.

First Look: New film on Shiney case

Bollywood is at it again. That is, cashing in on real life sensational events. Shiney Ahuja’s rape case has inspired a film and its title exposing the darker side of Bollywood.

The film based on a rape incident was earlier titled Production 4 but the makers found the new title more apt, following the case of Shiney Ahuja allegedly raping his maid. The film depicts the darker side of Bollywood stars like extra-marital affairs and how junior artistes are sexually exploited while they are looking for a break in films.

The lead of the film is a domestic help. A known face will play Shiney’s wife.

The film will go on the floors next week. The cast and crew of the movie is unknown. Qamar Jahipuri is the director, K A Johar is the producer and Hiten Raghir and Divvya Trivedi are the actors.

Victim contradicts herself in Shiney Ahuja case

Just as Bollywood actor Shiney Ahuja was remanded to judicial custody – meaning he would be shifted from the police lockup to Arthur Road Jail in Central Mumbai, the first chinks in the armour of the alleged victim’s testimony have cropped up.

According to another domestic help at Shiney Ahuja’s house Sangeetha, on the fateful day, she had asked the victim to accompany her when she left the premises at about 5 pm. The alleged victim had refused to go with her and insisted on staying on in the house, knowing well that she was all alone in the flat.

The same victim in her statement to the police and in the FIR has stated that Shiney Ahuja had allegedly tried to get fresh with her and tried to molest her the previous day.

Even a simpleton would understand that no 17 or 18 or 20 year-old girl would want to stay alone in a flat with a man who had tried to molest or touch her or made advances towards her just a day before. She would have tried her level best to ensure that her “sister maid” was also there with her or would have tried to leave with the other maid.

But in this case, the sister maid while leaving actually asked the alleged victim to accompany her while she went to attend a church service (according to her sister maid Sangeetha, it was the victim's idea earlier to join her) but the victim refused to go with her knowing well that she would be alone in the house with Shiney Ahuja who had just a day before tried to molest her according to her very own statement to the police.

Now is this the normal behaviour of a young girl – irrespective of whether she is a virgin or not or has been accustomed to sex or not? To the best of my knowledge and belief any girl or even a hard-boiled aspiring Bollywood actress who has learnt how to avoid the lecherous C-grade producers and other ‘hawks’ would try to get away as quickly as possible from a man she perceives or thinks could act fresh or smart with her.

This argument brings to the fore the conspiracy theory put forth in another article by Flynn Remedios (Has Shiney Ahuja been framed?). Further, it probably also explains why the alleged victim’s so-called boyfriend or friend suddenly has gone underground and switched off his phone when the media began hunting for him after his presence in the drama was exposed by Flynn Remedios in the same article.

This could also explain Shiney Ahuja’s initial and first statements to the police when he was picked up and brought to the police station. Shiney Ahuja had maintained that the sex was consensual and that they had even ‘done it a day before’.

Shiney almost raped

The actor who spent half of the day in the court lock up was repeatedly teased and slapped about by the other inmates yesterday.They even groped him and behaved inappropriately with him.

Shiney had eased up when he met his family at court and he even shouted an ‘I love you’ at his wife Anupam before the court proceedings began. But little did Ahuja know that there were a pack of ravenous inmates waiting for him to get back to the lock-up. The actor was sent to the Arthur Road jail where he was to share space with 15 prisoners all booked for different offences.

The inmates soon recognised the actor and teased him saying, “Arey yeh to wohi filmstar hai, jisne apni bai ka game bajaya.” They then began to grope him and slapped him around. Shiney soon started crying and screaming for his life.

Shiney was crying for the safety of his honour.

He called the guards to shift him from the cell and they put him in a corner of another cell with a guard for safety. But that wasn’t the end of it, when he was leaving from the jail the inmates began abusing him on his way out and created a huge ruckus.

A maid who worked for the actor before the one who claims to have been raped, has gone on record to claim that the new maid was in love with the actor and so they got physical.

This clean chit did not help Shiney's case in court. Shiney is reprimanded for another 15 days in jail. Lawyers say that the former maid's testimony could be a ray of hope for Shiney Ahuja as far as getting bail is concerned. Anupam (his wife) will apply for bail today.

His lawyer Shrikant Shivade feels since all tests in this case have been carried out, Shiney does not need to be kept in police custody. The prosecution wants him in custody till the medical reports arrive. His blood and urine samples have been collected for forensic reports to ascertain if he was under the influence of drug at the time of the incident.

Shiney met his wife in court and whispered to her, "things will be fine."

Shiney moved to Arthur Road jail

Bollywood actor Shiney Ahuja, accused of raping his domestic help, was moved to Arthur Road jail after his judicial custody was extended till July 2 by a local court.

Ahuja was remanded after the prosecution said that they want to investigate if the actor had consumed drugs or was under the influence of alcohol at the time of the incident.

The prosecution, in its remand application, also stated that the medical reports of both the accused and the victim were not yet ready and the blood report of the accused is yet to be taken.

Besides, Ahuja is not cooperating with the investigation, the prosecution claimed. Defence lawyer, Shrikant Shivade, however, argued that the prosecution is seeking Ahuja's custody on speculative evidence.

"Shiney is a teetotaller and does not consume drugs. His urine and blood samples have already been taken by the police and thus his custody is not required," Shivade said.

He also said that Ahuja should not be handcuffed when being brought from the lockup to the court since he is not a terrorist or a dreaded criminal.

The magistrate asked Ahuja if he had any complaint against the police to which he said "no".

Anupam Ahuja: Even a woman can rape a man

In spite of the mounting evidence against Shiney Ahuja who has allegedly raped his 18 year old maid, his wife refuses to believe that he has committed the heinous crime. We attended the press conference held yesterday, where she defended her husband.

“He is being framed,” she said, adding, “I don’t know why he is being framed and by whom.”

“I trust my husband and he is incapable of committing such a heinous crime. This is not blind love speaking, I have known him for fifteen years. He does not drink or smoke and he doesn’t attend parties. I am proud to be Mrs. Shiney Ahuja,” said the wife.

She hasn’t met him since he was arrested on Sunday though she saw him at court. Anupam even refuses to believe the test results which are against Shiney as they prove he raped his 18 year old maid. She said, “Who has seen these tests and how can they be trusted? I do not believe what is appearing in the papers. Every paper has a different story. They said that I was overseas with my daughter which I obviously wasn’t.”

She said that she respects and has complete faith in the Indian judiciary which will prove her husband is innocent. She also added that this case has to be fought in court and not in the media. She went on to say that “even a woman can rape a man.”

When asked what she would do if her husband was proven guilty, she asked, “Can the sun rise from the west? Then how can my husband be guilty?”

She also said that all of Bollywood is supporting her and husband, as she has received messages from people in the industry and “everyone knows he is innocent.”

'Shiney has been crying for two days'

Bollywood actor Shiney Ahuja, who is in police custody on the charge of raping his teenaged housemaid, looks haggard since he has been crying for the past two days and hasn't slept much, a police official in Mumbai said on Wednesday (June 17, 2009).

Lodged in a small cell inside the lock-up of Andheri police station, Shiney has virtually collapsed under the strain of the charges against him.

"Since the past two days, he has been crying and weeping. He looks weary and tired, and is not getting proper sleep," said the official, who did not wish to be named.

The investigators have also found that a non-cognisable offence of sexual harassment was registered against Shiney some time ago. However, there was no confirmation whether his flat in the upmarket Versova area has been raided or sealed.

On Wednesday, DNA samples taken by forensic experts from clothes and other personal belongings of the actor and the victim were sent for tests.

Medical tests conducted earlier had confirmed that the teenage girl had been raped.

"The findings of the medical report confirm the statements in the victim's first information report (FIR)," Deputy Commissioner of Police (Zone VI) Niket Kaushik told IANS on Tuesday.

In another alarming disclosure, Kaushik said that as per general physical examination, the victim could be aged between 17-18 years making her a minor as per Indian laws.

"In order to determine her correct age, we are now planning to send her for appropriate dental and bone examinations, so I cannot comment anything on this aspect immediately," Kaushik said.

The victim, a resident of Vasai suburb in neighbouring Thane district, used to commute by local train to Shiney's home daily for doing household chores along with two other part-time servants.

Last Sunday, she lodged a complaint against Shiney, accusing him of rape, threats to kill and illegally confining her, leading to the actor's arrest.

Shiney has been framed, says wife

Bollywood actor Shiney Ahuja's wife Anupama on Wednesday (June 17, 2009) said he was being framed in the rape case involving his domestic help and added she had no qualms in saying she is "Mrs. Shiney Ahuja".

Speaking to a large crowd of mediapersons, Anupam said she doesn't know who is behind the alleged frame-up, but expected the truth to come out soon.

Maintaining that she would not speculate or the motives, she said: "But it is hundred percent a frame-up.

"I don't know why he is being framed up, maybe because he is a celebrity or because he is a soft target," said Anupama who has known Shiney for 15 years.

"The police are doing their duty and the matter has to be proved in the court of law. I am confident that the truth will come out in the court soon," she added.

Rubbishing media reports that Shiney had confessed to raping his teenaged maid, Anupama said this was a wild speculation without basis.

"What will you believe? Every day there are different versions of the same thing. But truth has only one version. Truth is universal and it cannot have multiple versions. The truth is that my husband is absolutely innocent, and truth will win," Anupama said.

Aked if she had met the actor in the Andheri police station lock-up, Anupama said she did not need to meet him to know the truth.

"Yes, I have seen him in court, I looked in his eyes and I knew the truth. I don't have to meet him to know what he said. There is a legal system and through proper channels I have learnt that he has not confessed."

To a question, Anupama said she is proud to be Shiney's wife and that he has been a good husband, good father and a good life partner.

"I am not a girl in love with him blindly, I know him for 15 years, he has no vices... doesn't drink or smoke and comes home regularly," she said.

"The findings of the medical report confirm the statements in the victim's first information report (FIR)," Deputy Commissioner of Police (Zone VI) Niket Kaushik told IANS on Tuesday.

In another disclosure, the official said that a physical examination of the victim indicated she could be aged between 17-18 years, making her a minor as per Indian laws.

She also slammed the reports that the actor had "confessed" to raping his maid. "It is a lie...utter rubbish," she said.

Shiney's parents, who stay in Noida near New Delhi, too have flown to Mumbai.

Asked how they were coping with news, lawyer Shivede said: "Of course, they are shocked. They are not happy."

Shiney is an alumnus of the Army Public School and Hansraj College, New Delhi.

He started his acting career in 2003 with the critically acclaimed "Hazaaron Khwaishein Aisi".

Later, he acted in movies like "Gangster", "Karam", "Woh Lamhe", "Fanaa", "Hijack", "Life in a Metro" and the box-office hit "Bhool Bhulaiyya".

He has bagged over half a dozen acting awards in the past six years for his roles.

The 19-year-old maid lodged a complaint with the Oshiwara police station in Andheri (West) on Sunday evening, and police summoned Ahuja for questioning, a police official said.

After medical tests were conducted on both Shiney and the maid, the actor was arrested and investigations are on. Shieny would be produced before a court in Andheri on Monday morning.

The maid had been working at Ahuja's apartment for nearly a year, police said.

Shiney's wife, daughter and parents were away in Delhi at the time of the alleged rape, and only the maid and the actor were present in his apartment.

According to a report, "Ahuja initially denied the crime, but later broke down into tears and confessed that he had raped the maid."

Medical tests were conducted on the actor and the victim early on Monday.

"As of now, he is headed to the court for legal proceedings. But, in any case, he will have to stay here in our custody for at least the next 10-15 days before being sent to the jail," a police official told IANS.

The domestic help lodged a complaint with the Oshiwara police station in Andheri (West) on Sunday evening and police summoned Ahuja for questioning.

The 36-year-old actor, who has featured in films like "Hazaaron Khwaishein Aisi", “Hijack” and "Gangster", has admitted to having a "physical relationship" with the woman, police said.

The actor is reportedly separated from his wife and lives alone in Mumbai. He has a daughter.
